OdinEye Terms of Service

1. Acceptance of Terms & Eligibility

Welcome to OdinEye (the "Application" or "Service"), developed and published by OdinEye Health ("we", "us", or "our"). Package Identifier: com.odineye.health.

By downloading, installing, accessing, or using OdinEye, you ("User" or "you") acknowledge that you have read, understood, and agreed to be bound by these Terms of Service ("Terms") and our companion Privacy Policy. If you do not agree to these Terms, you must not download, install, or use the Application.

Eligibility

You must be at least 18 years of age (or the age of legal majority in your country or jurisdiction) to use OdinEye. If you are between 13 and 17 years of age, you may only use the Application with the affirmative consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

2. Medical & Non-Diagnostic Disclaimer (Critical Notice)

1. Informational and Wellness Purposes Only: All recovery scores, 4-stage sleep duration percentages, nocturnal pulse dip calculations, cardiovascular indicators, mindfulness timers, and on-device AI observations are generated solely for general fitness, mindfulness, and athletic awareness.
2. Not Evaluated by Health Authorities: The Application, its algorithms, and mathematical synthesizers have not been evaluated, tested, approved, or cleared by the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), or any other governmental medical regulatory body.
3. No Substitute for Professional Healthcare: Never disregard professional medical advice, delay seeking clinical consultation, or alter pharmaceutical regimens because of information observed in OdinEye.
4. Medical Emergencies: If you believe you are experiencing acute cardiovascular distress, heart palpitations, severe respiratory difficulty, or an adverse pharmaceutical reaction, immediately call emergency medical services (911, 112, or 999) or proceed to the nearest emergency room.
5. Medication Reminder Disclaimer: The medication adherence feature is an organizational scheduling tool operating via local Android alarms. Device battery optimization (Doze mode), power interruptions, or system task killing can disrupt notifications. You remain solely responsible for your medication schedule.

3. Local-First Architecture & User Security Responsibility

OdinEye is engineered on an uncompromising Local-First, Zero-Knowledge Privacy Model. We do not host remote user accounts or centralized database servers.

Because encryption keys and personal health records reside strictly on your physical Android hardware:

• You are solely responsible for maintaining physical device security, biometric locks, screen PINs, and backup hygiene.
• If you uninstall the Application, clear app data via Android system settings, or tap "Wipe Vault & Delete Keys", your cryptographic keys and historical records are permanently destroyed. We cannot recover lost local data.

4. Third-Party Services & API Integrations

OdinEye provides optional direct client-side synchronization with supported health telemetry providers:

Your use of third-party platforms is governed strictly by each provider’s respective terms and privacy policies. We make no warranties regarding third-party server uptime, API rate limits, or external sensor accuracy. You may disconnect any service at any time via Settings → Data Sources.

5. Intellectual Property & Limited License

Open Source License: OdinEye source code is released under the permissive MIT Open Source License. You are free to inspect, audit, fork, and compile the code in accordance with the license conditions.

Trademarks & Brand Assets: The name "OdinEye", the OdinEye logo icon, customized brand illustrations, and product presentation designs are proprietary assets of OdinEye Health. You may not use OdinEye trademarks in a manner that implies formal commercial endorsement without prior written authorization.

6. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW:

• THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
• WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SYSTEM COMPATIBILITY, AND NON-INFRINGEMENT.
• WE DO NOT GUARANTEE THAT THE APP WILL OPERATE COMPLETELY ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ALL HARDWARE WEARABLES AND SMART RINGS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• IN NO EVENT SHALL ODINEYE HEALTH, ITS DEVELOPERS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING PERSONAL INJURY, MISSED MEDICATION DOSES, INCORRECT SLEEP INTERPRETATION, HARDWARE FAILURE, OR LOSS OF DATA.
• OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO YOUR USE OF THE APPLICATION SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE APPLICATION, OR FIFTY U.S. DOLLARS ($50.00 USD), WHICHEVER IS LESS.

8. Data Deletion & Termination

You have complete autonomy to terminate these Terms at any time:

1. Open OdinEye and navigate to Settings → Category 04: Hardware Security.
2. Tap Wipe Vault & Delete Keys to purge all encrypted credentials, medication schedules, and caches.
3. Uninstall the Application from your Android smartphone.

Because no data is ever transmitted to a cloud account, uninstalling the app permanently purges all associated information from existence.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the OdinEye Health project maintainer is organized, without giving effect to any conflict of law principles. Any legal action or proceeding arising under these Terms shall be instituted exclusively in the applicable courts of that jurisdiction.
